This Privacy Policy describes how StaffUpApp and StaffingOS®(“we,” “us,” or “our”) collect, use, and protect personal information in connection with our websites, mobile applications, and related services (collectively, the “Services”).
By using the Services, you agree to the collection and use of your information in accordance with this Policy.
1. Who We Are
StaffUpApp and StaffingOS® provide mobile-first and cloud-based staffing technology that helps connect staffing firms (“Staffing Firms”) with job candidates (“Candidates”).
When Candidates use our Services to apply for jobs, complete onboarding forms, or communicate with Staffing Firms, we may process information either:
On behalf of Staffing Firms as a service provider or processor; or
As a data controller when Candidates or Staffing Firms use our broader platform features (for example, profile creation or analytics).
When acting as a service provider, the Staffing Firm determines how candidate data is collected and used. Candidates should review the privacy policy of the Staffing Firm they are engaging with.
2. Information We Collect
We collect information directly from you, automatically through your device, and from third parties. The type of information depends on your relationship with us.

a. Candidate Data
We do not sell or share Candidate personal information with third parties for marketing purposes.
We may disclose data only to:
The Staffing Firms with whom you engage directly
Our trusted service providers who process data on our behalf (e.g., hosting, analytics, payment, communications)
Regulators, courts, or law enforcement where required by law
b. Staffing Firm Data
Information may be shared with service providers who support billing, analytics, hosting, or customer communications.
SMS Communications: Text messaging opt-in data and consent will never be shared with third parties for marketing purposes. Users may reply STOP to opt out or HELP for assistance. Message frequency varies; standard rates may apply.
6. Aggregate and De-Identified Data
We may use de-identified or aggregated data for internal analytics, trend analysis, or improving our Services. This information cannot reasonably be used to identify you.
7. Your Rights and Choices
Depending on your location, you may have rights regarding your personal information.
a. Account Control
Candidates can update or delete their app profiles at any time. Deleting your profile within the app will not remove data retained by the Staffing Firm; contact the Staffing Firm directly for removal.
b. California Residents (CCPA/CPRA)
You have the right to:
Know what categories of personal information we collect and how we use it
Request access to or deletion of your personal information
Correct inaccurate personal information
Opt out of the sale or sharing of your personal information (we do not sell personal information)
Receive equal service even if you exercise your privacy rights

c. Nevada Residents
We do not sell “covered information” as defined by Nevada law. You may still email support@StaffUpApp.com to opt out of any potential future sale.
d. EU & UK Residents (GDPR)
You have additional rights including:
Access, rectification, and erasure of your data
Restriction or objection to processing
Data portability
Withdrawal of consent
If you believe we have not handled your data properly, you may file a complaint with your local data protection authority.
8. Data Processing and International Transfers
We operate globally. Your data may be stored or processed in the United States or other countries where StaffUpApp and StaffingOS™ or its service providers operate.
We ensure appropriate safeguards, such as Standard Contractual Clauses, to protect your information when it is transferred internationally.
9. Security
We use administrative, technical, and physical safeguards to protect your data. Despite our efforts, no system is completely secure.
You are responsible for keeping your login credentials confidential. Please do not share passwords or sensitive data through in-app messages.
10. Data Retention
We retain personal data for as long as necessary to provide the Services, comply with legal obligations, resolve disputes, or enforce agreements.
11. Third-Party Links and Integrations
Our Services may link to third-party websites or tools.
When you access third-party features, their privacy policies apply. StaffUpApp and StaffingOS® are not responsible for third-party content or practices.
12. Children’s Privacy
Our Services are not directed to children under 13.
If you believe a child under 13 has provided information, contact security@StaffUpApp.com and we will delete it promptly.
13. Changes to This Policy
We may update this Privacy Policy periodically. The “Last Updated” date at the top indicates the latest revision.
If material changes occur, we will notify users as required by law. Your continued use of the Services after any changes constitutes acceptance of the revised Policy.
